The Amsterdam Court of Appeal sentenced former cultural platform Moam director Martijn N.

to 3.5 years in prison on Monday for a series of sexual offenses involving young men and teenagers.

The 37-year-old fashion entrepreneur was convicted of two counts of rape, one count of sexual assault, and committing lewd acts with two 15-year-old boys between 2011 and 2021.

This ruling significantly increases the initial 1.5-year sentence imposed by the district court after prosecutors appealed the lighter verdict.

Court Findings

The appellate court found sufficient legal and convincing evidence for the two rapes, charges for which the lower district court had previously acquitted him due to a lack of evidence.

Judges stated that N. consistently disregarded the boundaries of his victims to prioritize his own desires.

The court characterized his sexual interactions with the two minors as deeply disturbing due to his aggressive and overbearing behavior.

“The defendant applied various forms of coercion, from intimidation to violence,” the court stated.

The panel further emphasized that the defendant took deliberate advantage of his victims' youth and sexual inexperience.

The appellate judges noted that the encounters left the teenage boys with deeply distressing experiences.

The Public Prosecution Service had demanded a seven-year prison sentence covering ten alleged sexual offenses. However, the court acquitted N.

of four remaining rape charges and one count of attempted rape because of insufficient evidence.

The criminal case originally developed in 2021 following investigative reports published by Het Parool and NRC.

The newspapers interviewed over 100 individuals, resulting in 28 young men stating they experienced abuse by N. , and 18 men subsequently reporting their experiences to the police.

N. did not attend the verdict reading in person and was represented by his legal counsel.

Throughout the legal proceedings, he consistently maintained his innocence regarding the allegations of forced sexual contact.

“If someone clearly says no, then it is no,” N. said.

The court rejected N.' s defense that his behavior was confined to consensual dominance in the bedroom.

Judges ruled that his belief that partners could always freely refuse demonstrated a severe underestimation of his intimidating and violent actions.

The court initially set a baseline sentence of 50 months in prison for the proven offenses.

However, judges deducted eight months from the final sentence due to the age of the offenses, intense media scrutiny, somewhat diminished accountability, and a violation of the reasonable time limits for legal proceedings.

Additionally, N.

was ordered to pay financial compensation to the victims, with individual restitution amounts ranging from 4,000 to 6,100 euros.

Defense attorney Gerard Spong, who had argued for a full acquittal, indicated that the defense team is currently considering filing a final appeal with the Supreme Court.
