A Georgia judge has thrown out key evidence in the DUI case against actress Tiffany Haddish, ruling that police made critical mistakes during the traffic stop.

Thompson of Fayette County State Court issued the order on Wednesday, May 20, 2026, suppressing the horizontal gaze nystagmus eye test and statements Haddish made after her arrest.
The court found that the officer failed to administer the eye test smoothly and ignored Haddish's warning that she has a lazy eye.
Additionally, officers did not read Haddish her Miranda rights before questioning her in the patrol vehicle.
However, the judge upheld the validity of the walk-and-turn and one-leg-stand tests, ruling that they provided sufficient probable cause for the arrest.
The traffic stop occurred on January 14, 2022, after police responded to 911 calls about a driver asleep at the wheel of a white SUV at an intersection around 2:30 a.

Defense attorneys Marissa Goldberg and Drew Findling have separately filed a motion to dismiss the entire case, arguing that the nearly 52-month delay violates Haddish's constitutional right to a speedy trial.

According to the defense, Haddish announced she was ready for trial approximately 10 times over the last two years, but the court repeatedly stated it was still working on key rulings.
"The procrastinated failure to rule on a misdemeanor case with no victims or injuries is unprecedented," the attorneys stated.
They argued that the ongoing legal limbo has financially damaged Haddish by blocking necessary international travel documents for entertainment projects in destinations such as Australia.
"Fairness and the constitution require that the court dismiss this case," the defense added.
Haddish previously resolved a separate November 2023 Beverly Hills DUI arrest by pleading down to reckless driving, which required probation and sobriety classes.
She later discussed her lifestyle changes in a public interview and on Amanda de Cadenet's podcast "The Conversation."
The Fayette County Solicitor's Office has not yet commented on the motion to dismiss.

Haddish is next scheduled to appear in court on June 6, 2026.
